111-22 S. 896 "Helping Families Save Their Homes Act of 2009" and "Homeless Emergency Assistance and Rapid Transition to Housing Act of 2009". To prevent mortgage foreclosures and enhance mortgage credit availability. (73 pages)
This act makes several changes to the insurance funds administered by the Federal Deposit Insurance Corporation (FDIC) and the National Credit Union Administration (NCUA). First, the law temporarily increases (until December 31, 2013) the amount of individual deposits insured by the FDIC and NCUA from $100,000 to $250,000. It also allows those agencies to replenish their insurance funds over a longer period of time and increases the amounts each agency can borrow from the Department of the Treasury. S. 896 also modifies the Hope for Homeowners loan guarantee program authorized by the Housing and Economic Recovery Act of 2008 and reduces the Secretary of the Treasury’s authority to purchase troubled assets under the Emergency Economic Stabilization Act of 2008.

S. 454 would make several changes to the Department of Defense’s (DoD) acquisition procedures and regulations for Major Defense Acquisition Programs. In addition, the bill would require DoD to create the positions of Director of Developmental Test and Evaluation and Director of Independent Cost Assessment within the Office of the Secretary of Defense, and would result in the reorganization of some existing programs and activities under those new positions.

To amend the Truth in Lending Act to establish fair and transparent practices relating to the extension of credit under an open end consumer credit plan, and for other purposes. (34 pages)
This act amends the Truth in Lending Act to restrict the use of a number of billing practices applied to consumer credit cards, including those related to changes in interest rates and calculations of balances to which interest rates are applied. It directs the Board of Governors of the Federal Reserve System, in consultation with other financial regulatory agencies, to issue regulations implementing the new standards. It also increases the information that the Federal Reserve is required to collect on the financial activities of credit card issuers. Finally, it requires the Federal Reserve to report to the Congress about certain practices of credit card issuers, the prevalence of those practices during the 3 years preceding enactment of the bill, and recommendations for regulations or statutes to prevent such practices.

To protect the public health by providing the Food and Drug Administration with certain authority to regulate tobacco products, to amend title 5, "Government Organization and Employees", United States Code, to make certain modifications in the Thrift Savings Plan, the Civil Service Retirement System, and the Federal Employees’ Retirement System, and for other purposes. This act authorizes the Food and Drug Administration (FDA) to regulate tobacco products, and requires the agency to assess fees on manufacturers and importers of tobacco products to cover the cost of FDA’s new regulatory activities.
The act establishes a Roth contribution program (in which contributions to the retirement accounts will be made on an after-tax basis) for the Civil Service Retirement System, and the Federal Employees’ Retirement Systemand will result in some Thrift Savings Plan (TSP) participants electing to contribute after-tax income to their retirement plan rather than contributing pre-tax amounts. The act also requires that newly hired federal employees who are eligible for the TSP be automatically enrolled in that program, creating a greater and earlier participation rate of employees in the program.

This act allows entities that broadcast audio content over the Internet (Webcasters) to continue to negotiate royalty rates with SoundExchange, the entity designated to collect royalties for the music industry. Under provisions of the Webcaster Settlement Act of 2008 (Public Law 110-435), SoundExchange was given limited authority to enter into royalty fee agreements with Webcasters that would differ from the rates established by the Copyright Royalty Board. This limited authority expired on February 15, 2009; the current act would extend the authority for 30 days after the date of enactment of the bill.

To amend Title 38, "Veterans' Benefits", United States Code, to provide for an increase, effective December 1, 2009, in the rates of compensation for veterans with service-connected disabilities and the rates of dependency and indemnity compensation for the survivors of certain disabled veterans, to codify increases in the rates of such compensation that were effective as of December 1, 2008, and for other purposes. This act will increase the amounts paid to veterans for disability compensation and to their survivors for dependency and indemnity compensation by the same cost-of-living adjustment (COLA) payable to Social Security recipients. The increase will take effect on December 1, 2009, and the resulting adjustment will be rounded to the next lower dollar. This act also codifies the rates of disability compensation as adjusted by the 2008 COLA.

Amends the National Defense Authorization Act for Fiscal Year 2008 to authorize the Special Inspector General for Afghanistan Reconstruction (SIGAR) to exercise certain employment and employment-related authorities currently permitted for the heads of temporary organizations established by law or executive order. The bill would provide additional personnel authorities to the Special Inspector General for Afghanistan Reconstruction similar to those provided to the Special Inspector General for Iraq Reconstruction (SIGIR). According to the SIGAR, the agency, up to now, has been able to bypass the standard hiring process by hiring all of its employees through the SIGIR—which already has the additional authorities provided in this bill—and then having these personnel detailed to the SIGAR.

111-42 H.J. Res. 56 Approving the renewal of import restrictions contained in the Burmese Freedom and Democracy Act of 2003 (Title I), and for other purposes (Title II: "Corporate Estimated Tax Shift Act of 2009"). (2 pages)
H.J. Res. 56 renews for one year the ban on all imports from Burma, including a ban on imports of certain gemstones originating from Burma. The ban was originally enacted as the Burmese Freedom and Democracy Act of 2003 (Public Law 108-61) and was set to expire on July 28, 2004. The ban had been renewed five times through its previous expiration date of July 28, 2009. Previous legislation limited renewals of the ban to a total of six years. This act will increase that limit to nine years, thereby allowing three additional one-year bans. The act also extends customs user fees and shifts some corporate estimated tax receipts between years. Under H.J. Res. 56, the President can lift the import restrictions if the State Peace and Development Council, the military regime of Burma, has made substantial and measurable progress to end violatiations of human rights, implemented a democratic government, and met its obligations under international counter-narcotics agreeeements. The President also has the authority to terminate the restrictions upon the request of a democratically elected government in Burma or waive them in the national interest.

CBO estimates that extending the ban on U.S. imports from Burma and shifting corporate tax receipts will increase federal revenues by $142 million over the 2010 - 2014 period and reduce them by $2 million over the 2010 - 2019 period. Additionally, CBO estimates that H.J. Res. 56 will increase offsetting receipts by $11 million in 2018.

The legislation contains several tax provisions, including temporarily exempting from payroll taxes paid by employers the wages of certain individuals hired in 2010, providing an additional business tax credit for firms that retain such individuals for at least one year of employment, increasing allowable expensing in 2010 for certain depreciable business assets, amending the treatment of interest paid in connection with issuances of certain tax credit bonds, and modifying rules applicable to foreign accounts and the allocation of interest expenses on the part of corporations with worldwide activities.
In addition, the legislation would extend through December 31, 2010, the authorization for surface transportation programs and would increase the budgetary resources for those programs by $20.8 Billion in fiscal year 2010 and $12.2 Billion in fiscal year 2011, relative to the amounts assumed in CBO's baseline. However, the CBO estimates that Congress will only appropriate $210 Million of the $33 Billion authorized here for 2010 - 2011. Finally, the bill would provide for the transfer of $19.5 Billion from the general fund of the Treasury to the Highway Trust Fund. Spending from the trust fund, however, is generally controlled by appropriation actions; as a result, the transfer may facilitate future spending but would not, by itself, increase such expenditures.

Authorizes the President to provide additional assistance to respond to the humanitarian needs of populations the Democratic Republic of Congo, southern Sudan, and Central African Republic affected by LRA activity. Authorizes the President to support efforts by the people of northern Uganda and the government of Uganda to promote transitional justice and reconciliation on both local and national levels, including to encourage implementation of the mechanisms in the Annexure to the Agreement on Accountability and Reconciliation between the government of Uganda and the LRA.
The bill would authorize the appropriation of $10 million a year over the 2011-2013 period to support reconciliation between the government of Uganda and the Lord’s Resistance Army. In addition, the bill would authorize the appropriation of $10 million in 2011 to provide humanitarian assistance to areas outside Uganda that have been affected by the Lord’s Resistance Army.

Requires the FAA Administrator to establish the FAA Task Force on Air Carrier Safety and Pilot Training to evaluate, make recommendations, and report to Congress on best practices in the air carrier industry. Directs the FAA Administrator to establish a number of procedures to improve flight crewmember training. Requires the FAA Administrator to issue regulations to limit the number of flight and duty time hours allowed for pilots to address pilot fatigue. Directs the FAA Administrator to conduct a rulemaking proceeding to modify minimum federal requirements for the issuance of airline transport pilot certificates. Finally, the act would authorize the appropriation of $300 million to establish a program at the Small Business Administration to create a fund that could be tapped by certain borrowers for payments of principal and interest on loans guaranteed by the agency.
